Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Infoportfolio LLC, a New Hampshire limited liability company that owns and operates the Charity Record donation-tracking service at charityrecord.com (collectively, "Charity Record," "we," "us," or "our"). When these Terms refer to "Charity Record" they cover the site at charityrecord.com, our progressive web app, and the Charity Record APIs only; they do not govern any other Infoportfolio LLC websites or services.

1. Acceptance of Terms

By creating an account, completing the registration form (including any required acknowledgments), or continuing to use Charity Record after we post updates, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the service.

2. Description of Service

Charity Record is a donation tracking application that helps you:

  • Record seven donation types: items, cash, mileage, stock & securities, vehicles, digital assets, and art & collectibles
  • Organize donation records by year and organization
  • Import donation history from CSV files (including historical ItsDeductible exports)
  • Export data for tax preparation or your own backups
  • Reference estimated fair market values based on IRS guidelines

Fair Market Value Sources

Charity Record references multiple public IRS resources (including Publications 526, 561, 544, 551, Form 8283 instructions, and IRS FAQs) plus the 2025 ItsDeductible fair market value guide that Intuit published when winding down ItsDeductible. We treat the publicly released 2025 guide as the authoritative default at launch and will note any future source changes in this document and in the public change-history link that will appear in the site footer.

ItsDeductible is a trademark of Intuit Inc. Charity Record is an independent product and is not affiliated with, endorsed by, or sponsored by Intuit.

Charity Record is not tax preparation software and does not provide tax advice. We provide tools to organize your data. You are responsible for consulting with a qualified tax professional about your specific tax situation.

Open Beta Program

Charity Record is currently in an open beta. Anyone can register, but features may change, be delayed, or be removed before general availability (targeted for December 2025). During open beta we may:

  • Limit access to specific users, regions, or time periods
  • Pause service for maintenance or to address issues
  • Modify or migrate data (we will give advance notice before any data deletion outside of Section 10)
  • Request feedback to help improve the product

By participating in open beta you acknowledge that the service is pre-release, may contain defects, and is provided without uptime guarantees. We appreciate your feedback and may use it without obligation to you.

3. Eligibility

You must be at least 13 years old to use Charity Record. By using the service, you represent that you meet this requirement.

4. Account Registration

You agree to:

  • Provide accurate, current information during registration
  • Maintain the security of your password
  • Notify us immediately of any unauthorized access
  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5. Early Access Pricing and Future Subscription

Open Beta (No Payments Yet)

During open beta you can manually track your first $500 in total donations for free, and you can import unlimited historical data without affecting that threshold. You can continue tracking above $500 while we are in beta, but once general availability launches we will apply caps or upgrade prompts consistent with the paid tiers we announce.

Upcoming Paid Subscription

General availability is targeted for December 2025, and the initial paid subscription is projected at $29.99/year for unlimited tracking. We will confirm final pricing, billing cadences, and cancellation terms before you enter any payment information. During GA we will also lock donation years based on when your account was created; open beta users can enter data for any year, but future accounts may be restricted to the tax years included in their plan. We will provide at least 30 days notice via in-app messaging and email before any paid plan becomes required or year-locking goes into effect.

Subscription payments (including any required sales or use taxes) will be processed by our merchant of record. Taxes, fees, or currency conversion charges assessed by that provider will be added to your invoice where legally required.

Service Announcements

Even if you opt out of marketing emails, we may still send transactional or service-related notices (for example, about pricing changes, feature availability, or terms updates) as they directly impact your ability to access the service.

6. Your Responsibilities

You agree to:

  • Accuracy: Enter accurate donation data and verify fair market valuations
  • Compliance: Follow IRS rules and tax laws for charitable deductions
  • Records: Maintain supporting documentation (photos, receipts, appraisals, etc.) as required by tax law
  • Prohibited use: Not use Charity Record for illegal purposes or to submit fraudulent tax information
  • No automated access: Not scrape, bot, or abuse our service

You are solely responsible for the accuracy of your donation records and tax filings. We provide tools to help you organize data, but we do not verify the accuracy of your entries or guarantee tax compliance.

7. Disclaimers and Limitations

No Tax Advice

Charity Record does not provide tax, legal, or accounting advice. Our fair market value references rely on the IRS sources listed above plus the 2025 ItsDeductible FMV guide, but they are not professional appraisals. Consult a qualified tax professional for advice specific to your situation.

No Warranty

The service is provided "as is" without warranties of any kind, express or implied. We do not guarantee:

  • Uninterrupted or error-free operation
  • Accuracy of fair market value estimates
  • Compatibility with all tax software
  • That exports will be accepted by the IRS or tax preparers

Service Availability and Maintenance

We target 99.9% monthly uptime but cannot guarantee the service will be available at all times. We may suspend access for planned maintenance, emergencies, security events, or factors outside our control (for example, power outages or upstream provider failures). We are not liable for any losses arising from such downtime, but we will make reasonable efforts to post status updates when issues are expected to last longer than routine maintenance windows.

Limitation of Liability

To the maximum extent permitted by law, Charity Record shall not be liable for:

  • Tax penalties, interest, or audits resulting from your tax filings
  • Professional fees or defense costs related to audits, tax disputes, or similar proceedings
  • Loss of data due to technical failures
  • Indirect, incidental, or consequential damages
  • Damages exceeding the greater of (a) the fees you paid us in the past 12 months or (b) $29.99

8. Data Ownership and Exports

You own your data. You can export all your donation records at any time in CSV format. We encourage you to keep backups of your data.

During open beta: Account deletion is immediate and permanent. Make sure to export your data before deleting your account.

After general availability: Once we add paid subscriptions, account deletion will have a 30-day grace period where you can reactivate. Data will be permanently deleted after 30 days, except as required for legal compliance or billing records.

9. Intellectual Property

Charity Record's code, design, logos, and content are protected by copyright. You may not copy, modify, or distribute our intellectual property without permission.

10. Abuse, Suspension, and Termination

We may suspend or terminate your account, remove specific donations, or block access if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Abuse or attempt to disrupt the service (including scraping, credential sharing, or exploiting rate limits)
  • Fail to pay subscription fees

We may remove unlawful or abusive data (for example spam imports, malicious scripts, or CSAM) without notice and will report illegal content to the appropriate authorities when required. If we later add file or photo uploads, you remain responsible for securing rights to anything you submit. To report alleged copyright infringement, email support@charityrecord.com with "DMCA" in the subject line, details about the work and its location, your contact information, and a sworn statement that you believe the use is unauthorized. We will remove infringing content where legally required.

You can delete your account at any time from your account settings. During open beta, deletion is immediate and permanent. After general availability, paid accounts will have a 30-day grace period to reactivate before permanent deletion.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email and by updating the "Last updated" date. Your continued use after changes constitutes acceptance of the new Terms.

12. Governing Law and Venue

These Terms are governed by the laws of the State of New Hampshire, without regard to conflict of law provisions. You agree that all disputes that are not resolved informally will be brought exclusively in the state courts located in Rockingham County, New Hampshire or the U.S. District Court for the District of New Hampshire, and you consent to personal jurisdiction in those courts. Nothing in this section prevents either party from seeking relief in New Hampshire small claims court if the claim qualifies.

13. Dispute Resolution and Arbitration

Before filing a claim, you agree to email support@charityrecord.com with a brief description of the dispute and allow us 30 days to resolve it informally. If we cannot resolve it, either party may elect binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted remotely or in Rockingham County, New Hampshire. We will pay any AAA filing fees beyond the first $75 you owe to file a claim, unless the arbitrator determines your claim is frivolous.

Arbitration means there is no judge or jury, and review is limited; however, the arbitrator can award the same individualized damages and relief that a court could. You and Charity Record agree that all disputes must be brought in our individual capacities and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate claims or otherwise preside over any form of class or representative action.

Either party may pursue a claim in New Hampshire small claims court instead of arbitration if it qualifies, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property or stop unauthorized access to the service. Apart from those limited exceptions, this Section 13 is the exclusive means of resolving disputes between us.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Charity Record.
